1. Introduction

Thank you for choosing Bivvy, Inc ("Bivvy," "we," "us," or "our") and for visiting www.trybivvy.com (the "Site"). Our mission is to unlock the value of your gold, jewelry, and diamonds quickly, securely, and transparently. We provide a modern, way to sell your valuables from the comfort of your home.

These Terms & Conditions of Sale and Website Use ("Terms") explain (1) how you may access and use the Site, and (2) the rules governing Bivvy's appraisal offers, purchasing, and payment services.

By shipping Items to Bivvy, clicking "I agree," or accepting any offer, you acknowledge that you have read, understood, and accept these Terms. By providing your phone number and opting in to SMS communications, you also agree to receive text messages from Bivvy as described in Section 5. If you do not agree, do not use our services.

Eligibility

The Site is intended for U.S. residents aged 18 years or older. You represent that you satisfy these requirements and lawfully own every Item you send. Bivvy may request government‑issued ID to verify eligibility and ownership.

Updates

Bivvy may amend these Terms at any time. Changes are effective when posted. Your continued use of the Site after changes are posted constitutes acceptance.

2. Shipping & Insurance

2.1 Requesting Your Shipping Label

You may generate a free, pre-paid FedEx shipping label through the Site. Your label will be delivered via email and/or SMS with a scannable QR code that can be used at any staffed FedEx Office or FedEx Ship Center location. Use of other carriers is not permitted without prior written consent from Bivvy.

2.2 Insurance Coverage

Every parcel shipped using a Bivvy-issued FedEx label includes third-party shipping insurance up to US $5,000 while in transit. Additional coverage is available upon request before shipping. Contact support@trybivvy.com to arrange.

2.3 Proof Bundle Requirements

To qualify for insurance coverage, you must complete all of the following:

Before Shipping:

  • Accept these Terms & Conditions through the Site
  • Submit clear photographs of all items via email or SMS, including individual item photos, close-ups of any hallmarks or stamps, and a photo of all items together with a handwritten note displaying the current date and your name
  • Complete the item declaration form on the Site with accurate descriptions

Packaging:

  • Place all items inside a FedEx Express Envelope and seal securely
  • Place the sealed Express Envelope inside a FedEx Padded Pak and seal again
  • Do not write any contents description on the exterior of the package

Drop-Off:

  • Deliver your package to a staffed FedEx Office or FedEx Ship Center location only; FedEx Drop Boxes are not permitted
  • Obtain a receipt or digital confirmation showing the FedEx tracking scan
  • Retain your receipt as proof of shipment

2.4 Voided Coverage: 

Insurance coverage is void if any of the following occur:

  • Failure to accept Terms & Conditions prior to shipping
  • Improper packaging, including single-layer packaging or use of non-FedEx materials
  • Use of a FedEx Drop Box instead of a staffed counter location
  • No receipt or scan confirmation obtained at drop-off
  • Use of a carrier other than FedEx without written consent
  • Submitted photographs do not match items received by Bivvy
  • Items received were not disclosed in the item declaration form
  • Evidence of misrepresentation, fraud, or tampering

2.5 Loss or Damage Claims

If your parcel is lost, stolen, or damaged in transit, email support@trybivvy.com within 15 days of the ship date. Bivvy will file and manage the insurance claim on your behalf, provided all Proof Bundle Requirements have been met. Bivvy reserves the right to deny claims where documentation is incomplete or packaging protocols were not followed.

2.6 Risk of Loss

Risk of loss transfers to the carrier once the package is scanned at a FedEx location. Parcels delivered to Bivvy without contents or with contents that do not match submitted documentation will be investigated. Fraudulent claims will be denied and may be reported to law enforcement.

3. Evaluation and Offers

Our certified precious metals experts evaluate your items using industry-standard testing methods and current market pricing.

Evaluation Process:

  • Expert assessment within 24 hours of receipt
  • Testing for purity, weight, and authenticity
  • Market-rate pricing based on current precious metals values
  • No-obligation offer sent via email an/or SMS
Offer Terms
All offers are valid for 2 business days from the date issued. Offers are based on market conditions at the time of evaluation and may not be extended beyond the expiration date.

4. Payment

Upon acceptance of our offer, payment is processed through our secure payout partner. You will receive a payout link via email and/or SMS to select your preferred payment method.

Payment Process:

  • Payout link delivered via email and SMS after you accept your offer
  • Select your preferred payment method through our secure payout portal
  • Payments processing times vary based on payout method
  • Confirmation sent once payment is complete
Important
Ensure all payment details are entered correctly. Bivvy is not responsible for payments delayed or lost due to incorrect information provided by the customer, including wrong account numbers, routing numbers, email addresses, or usernames. Some payment methods may have additional processing times or fees imposed by the receiving institution.

5. SMS/Text Messaging Communications

By providing your mobile phone number and checking the SMS consent box during the shipping label request process, you agree to receive transactional text messages from Bivvy related to your shipment and transaction.

Types of Messages:

  • Shipping label delivery and QR codes
  • Package tracking and delivery updates
  • Shipment receipt confirmations
  • Offer notifications and status updates
  • Customer support communications

Terms of SMS Service: 

Consent: Your consent to receive SMS messages is not a condition of any purchase or service. You may choose not to provide consent and still use Bivvy's services by contacting us directly.

Message Frequency:
Message frequency varies depending on your transaction status. You may receive approximately 3-6 messages per transaction.

Message and Data Rates: Standard message and data rates may apply based on your mobile carrier plan. Bivvy is not responsible for any carrier fees.

Opt-Out: You may opt out of SMS messages at any time by replying STOP to any message you receive. You will receive a single confirmation message acknowledging your opt-out request. You may also email support@trybivvy.com to unsubscribe from SMS communications.

Help: For assistance with SMS messages, reply HELP to any message or contact support@trybivvy.com.

Supported Carriers: Bivvy SMS services are supported on most major U.S. carriers including AT&T, Verizon, T-Mobile, Sprint, and others. Carriers are not liable for delayed or undelivered messages.

No Warranty: Bivvy makes no warranty, express or implied, regarding the availability, reliability, or timeliness of SMS messages. Message delivery is subject to effective transmission by your mobile carrier.

Changes to SMS Terms: Bivvy reserves the right to modify or discontinue SMS services at any time without prior notice.

6. Limitation  of Liability

Bivvy's liability is limited to the appraised value of your precious metals while in our possession, subject to proper packaging and declared value.

Liability Exclusions:

  • Sentimental or emotional value beyond market price
  • Items damaged due to improper packaging
  • Price fluctuations after payment
  • Wallet-related issues or incorrect addresses
  • Force majeure events beyond our control

7. Dispute Resolution and Arbitration

Any disputes arising from these terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Arbitration Terms:

  • Venue: Arbitration conducted in Delaware
  • Governing Law: Delaware state law applies
  • Individual Claims: No class action arbitrations
  • Final Decision: Arbitrator's decision is binding
