1. Introduction

Thank you for choosing Bivvy, Inc ("Bivvy," "we," "us," or "our") and for visiting www.trybivvy.com (the "Site"). Our mission is to convert your precious‑metal and gemstone valuables into cash or Bitcoin—quickly, securely, and transparently. These Terms & Conditions of Sale and Website Use ("Terms") explain (1) how you may access and use the Site, and (2) the rules governing Bivvy's appraisal offers, purchasing, and Bitcoin payment services.

By shipping Items to Bivvy, clicking "I agree," or accepting any offer, you acknowledge that you have read, understood, and accept these Terms. If you do not agree, do not use our services.

Eligibility

The Site is intended for U.S. residents aged 18 years or older. You represent that you satisfy these requirements and lawfully own every Item you send. Bivvy may request government‑issued ID to verify eligibility and ownership.

Updates

Bivvy may amend these Terms at any time. Changes are effective when posted. Your continued use of the Site after changes are posted constitutes acceptance.

2. Appraisal Process & Standard Insurance

1. Booking Your Shipment

Generate a pre‑paid, insured USPS label through the Site to ship your Items to Bivvy's processing facility. Other carriers are not permitted without our written consent.

2. Standard Insurance

Every parcel shipped on a Bivvy‑issued USPS label is insured for up to US $5,000 while in transit.

3. Optional Extra Insurance

Additional coverage-up to US $150,000-is available upon request before you ship. Email support@trybivvy.com to arrange.

4. Packaging Requirements

Failing to follow these instructions may void insurance.

5. Proof of Shipment

You must (a) obtain a printed drop‑off receipt showing the USPS tracking scan, and (b) photograph your Items before sealing the package. Bivvy may deny insurance assistance if a parcel was not scanned or was mis‑shipped.

6. Loss or Damage Claims

If your parcel is lost, stolen, or damaged in transit, email support@trybivvy.com within 15 days of the ship date. We will assist with the USPS claim. Except for that assistance and the coverage above, Bivvy bears no liability for transit losses. If you complied with all rules and USPS declares the parcel lost, Bivvy will pay documented value up to US $5,000.

7. Risk of Loss

Risk transfers to USPS once the package is scanned. Parcels delivered to Bivvy devoid of contents will be investigated; fraudulent claims may be denied.

3. Evaluation and Offers

Our certified precious metals experts evaluate your items using industry-standard testing methods and current market pricing.

Evaluation Process:

  • Expert assessment within 24 hours of receipt
  • Testing for purity, weight, and authenticity
  • Market-rate pricing based on current precious metals values
  • No-obligation offer sent via email
Offer Terms
All offers are valid for 7 business days from the date issued. Offers are based on market conditions at the time of evaluation and may not be extended beyond the expiration date.

4. Payment

Upon acceptance of our offer, payment is made directly to your specified Bank or Bitcoin wallet address.

Payment Process:

  • Bitcoin conversion rate locked at time of acceptance
  • Payment typically processed within 2-4 hours
  • Transaction sent to your provided wallet address
  • Blockchain confirmation serves as receipt
Important
Ensure your wallet address is correct. Bitcoin transactions are irreversible. Bivvy is not responsible for payments sent to incorrect addresses provided by the customer.

5. Limitation  of Liability

Bivvy's liability is limited to the appraised value of your precious metals while in our possession, subject to proper packaging and declared value.

Liability Exclusions:

  • Sentimental or emotional value beyond market price
  • Items damaged due to improper packaging
  • Bitcoin price fluctuations after payment
  • Wallet-related issues or incorrect addresses
  • Force majeure events beyond our control

6. Dispute Resolution and Arbitration

Any disputes arising from these terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Arbitration Terms:

  • Venue: Arbitration conducted in Delaware
  • Governing Law: Delaware state law applies
  • Individual Claims: No class action arbitrations
  • Final Decision: Arbitrator's decision is binding
